Every indevidual or business eterprise owes a duty of care to other third parties. Negligent act or omission could result in bodily injury or illness or disease to persons or loss or damage to property of others. Law suits taken by third parties could have a crippling financial effects on the individual or business enterprise if they are successful.

A Public Liability Policy is designed to provide an indemnity to Insured in respect of legal liability to pay compensation for the consequence of such negligent acts. It also covers costs and expenses of litifation recovered by an claimant against the Insured and incrurred with the written consent of Insurer. In some policies, such costs and expenses are included within the overall limit of indemnity.

 
Important Exceptions :

• Deliberate act or omission of the Insured where the consequences are foreseeable.
• Liability assumed by the Insured by agreement such as under a contract.
• Liability arising out of contract of employmaent.
• Insured's own property or those under care custody or control of the Insured.
• Bursing of any boiler, economizer, pressure vessel or apparatus.
• Damage due to vibration, removal or weakening of support.
• Liability in relation to ownerchip, possession or use machines or vehicle licensed for road use.
• Vessel or craft or air craft including loading or unloading there of.
• Lift, elevator, hoist or crane or other plant unless specifically insured.
• Accident due to unsuitability of berh dock or mooring.
• Products or contamination.
• War and kindred risks, civil war, mutiny, civil commotion etc, martial law or state of siege, acts of terrorism.
• Iconizing radiations or contamination by radioactivity from nuclear fuel etc.
• Nuclear weapons mateial.
• Breach of professional duty or service.

Common extensions :


Subject to adequate information and additional premiums, the following extensions are often provided :

• Cross Liabilites.
• Overseas Visits.
• Car park Endorsements.
• Food and Drink.
• Loading and Unloading.
• Private Work for Directors and Executives.
• Tenant's Liability.
• Non-owned Vehicle Liability.
• Advertising Signs Board.
• Indepentent Contractors.


G
enerally, the excess (the first amount of any loss to be borne by the Insured) will be in respect of third party property damage.
