(EMPLOYER'S LIABILITY INSURANCE)
 

Workers are a very important resource of the county and over the years, Governments of various countries have taken steps to protect the workers from exploitations. Apart from the need to provide appropriate equipments for the workers, employers are required by laws to provide a safe environment for the workers. It is now a requiremanet in respect of personal injury or disease caused in the course of employment. The law generally lay down minimum coverage.

A Workmen's Compensation Insurance Policy is designed to provide indemnity to the Insured in respect of compensation required under the relevant statutory liability to the workers. In addition, it must be noted that the workers may have a common law rights against the employers and hence, Employes's Liability Insurance is to provide indemnity to the Insured for that contigency.

 
Important Exceptions :

• Liability assumed by the Insured by agreement such ad under a contract.
• Liability to employess of independent contractors.
• Employee not considered as 'workman' under legislation.
• Injury sustained whilst the employee is under the influence of alcohol or a drug not prescribed by a doctor unless the Insured is liable by virtue under legislation.
• Any incapaciy or death through deliberate self injury etc.
• War and kindred risks, civil war, mutiny, civil commotion etc, martial law or state of siege, acts of terrorism.
• Ionizing radiations or contamination by radioactivity from nuclear fuel etc.
• Nuclear weapons material.

ost Underwriters would include certain trade warranties in order to improve the quality of the risks through specifying the extent of the activities or the way it should be conducted. Each case will be reviewed accordingly.
